Earldy Terms of Service

1. Introduction

Welcome to Earldy! Earldy is an online platform that connects users with various service providers in the housing and related sectors, including real estate, moving, home repair, insurance, and property management.

Earldy acts solely as a connector between users and service providers. We do not provide these services directly and are not responsible for the actions, reliability, or performance of any service provider.

By accessing or using Earldy, you agree to these Terms of Service, which outline your rights, responsibilities, and obligations while using our platform. If you do not agree to these terms, please do not use Earldy.

2. Eligibility

Minimum Age: You must be at least 18 years old (or the legal age in your country) to register and use the platform.
Accurate Information: You must provide true, current, and complete information when creating your account and maintain its accuracy.

If you do not meet these requirements, you must not use the platform.

3. Account Responsibilities

Account Security: Keep your login credentials safe and confidential. Do not share your password or allow others to access your account.
Account Activity: All actions taken through your account are your responsibility. Notify Earldy immediately if you suspect unauthorized access or any security breach.
Compliance: Use your account only for lawful purposes and in accordance with these Terms.

Earldy is not responsible for any loss or damage resulting from unauthorized access to your account or misuse of your credentials.

4. Platform Use

Earldy is designed to help users connect with service providers in the housing and related sectors. By using Earldy, you agree to use the platform responsibly and lawfully.

You must not use Earldy for any of the following:

Fraudulent, deceptive, or misleading activities.
Harassment, threats, or harm to other users or service providers.
Unauthorized access to other users’ accounts or data.
Spamming, advertising, or promoting unrelated services.
Posting content that is illegal, offensive, or violates the rights of others.

Earldy reserves the right to suspend or remove accounts that violate these rules or misuse the platform.

5. Payments and Fees

Earldy charges a platform fee for facilitating access to listings, reservations, and services between users and service providers. All applicable fees are clearly disclosed before payment is completed.

5.1 Platform Fees

Platform fees are included in the prices displayed on the platform unless stated otherwise:

Rental Properties: 10% of the rental price
Properties for Sale: A 6.5% reservation fee based on the listed property price
Other Property-Related Services: 10% of the service price

5.2 Property Reservation Fee (Properties for Sale)

For properties listed for sale, Earldy offers a reservation feature that allows a prospective buyer to temporarily reserve a property. The reservation fee:

Is calculated at 6.5% of the listed property price
Reserves the property exclusively for the buyer for a period of fourteen (14) days
Prevents the property from being reserved or taken by other users during the reservation period

The reservation fee is paid directly to Earldy as consideration for providing the reservation and exclusivity service.

The reservation fee is non-refundable once paid, regardless of whether the property sale is completed, except where required by applicable law.

Users acknowledge and agree that:

The reservation fee does not constitute a purchase, deposit, or down payment for the property
Payment of the reservation fee does not guarantee the completion of a sale
All due diligence, negotiations, contracts, and final payments are handled directly between the buyer and seller
Earldy is not a party to the property sale and does not provide escrow, legal, or title transfer services

5.3 Hospitality-Type Properties

For hospitality-type properties (including short-term stays, furnished stays, and similar accommodations), an additional 4.5% damage protection fee is added at checkout and displayed separately before payment is completed.

The damage protection fee is intended to address potential damage-related risks associated with hospitality stays. Earldy acts solely as a platform facilitator and does not provide insurance coverage.

5.4 Refunds and Cancellations

Refunds and cancellations are subject to the applicable cancellation rules displayed at the time of booking or reservation.

Unless otherwise stated:

Platform fees are non-refundable once a booking or reservation is confirmed
Reservation fees for properties for sale are non-refundable
Refunds required by applicable law will be honored

6. Content

Earldy hosts and displays content from both users and service providers, including listings, posts, photos, videos, documents, and messages. By using Earldy, you agree to the following:

Ownership: You retain ownership of your content, but grant Earldy a non-exclusive, worldwide, royalty-free license to use and display it.
Accuracy: All content must be truthful, accurate, and not misleading.
Responsibility: You are responsible for the content you post. Earldy is not liable for errors or damages arising from content.
Prohibited Content: Do not post illegal, offensive, harmful content, or content that infringes others’ rights. Earldy may remove such content.

7. Third-Party Services

Earldy may provide links to, or facilitate transactions with, third-party services, including service providers and payment processors. Earldy does not control these services and is not responsible for their actions, accuracy, or reliability.

For payments, Earldy uses Stripe, a trusted and secure payment processor, to handle transactions and KYC verification. By using Earldy, you agree that your interactions with third-party services, including Stripe, are governed by the terms and privacy policies of those services.

8. Disclaimers and Limitation of Liability

“As Is” Service: Earldy is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, or completely secure service.
No Direct Service Provision: Earldy does not provide services directly and is not responsible for service providers’ actions or performance.
Limited Liability: Earldy shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities.
User Responsibility: Users are responsible for their own interactions and transactions with service providers. Earldy encourages due diligence and responsible use.

9. Termination

Earldy reserves the right to suspend or terminate your account immediately if you violate these Terms or engage in unlawful, harmful, or abusive activities.

You will lose access to your account and associated content.
Pending transactions will be handled according to payments and refund policies.
Termination does not affect any rights or remedies Earldy may have under these Terms or applicable law.

10. Changes to Terms

Users will be notified of changes via email or platform notifications before they take effect.
By continuing to use Earldy after changes take effect, you agree to the updated Terms.
We encourage users to review the Terms regularly.

11. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the State of Wyoming, USA. Disputes will be resolved in Wyoming courts, unless otherwise agreed through arbitration or mediation. International users retain rights under local consumer protection laws.
